In these terms and conditions, “we” “us” and “our” refers to Augette Pty Ltd. Augette Pty Ltd is the company that owns bidmywedding.com.au. Your access to and use of all information on this website, including the purchase of credits, is provided subject to the following terms and conditions.
We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our website you read these terms and conditions.
1. Registered Users
1.1. In order to access the services provided on this website, you must become a registered user. You must complete registration by providing certain information as set out on our membership/registration page. Please refer to our Privacy Policy linked on our home page for information relating to our collection, storage and use of the details you provide upon registration.

1.2. You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details as and when they change.

1.3. Upon registration, we provide you with a password. Upon registration, you agree to pay for our services as set out on our website (relevant only to service providers as defined at paragraph 2.3).

1.4. We may, at our discretion, terminate your use of, or access to, our website at any time. If this happens, we may notify you by email. If your use of our website is terminated, you will not be authorised to access our website with your registered email address or any other email address and no refunds of any previous payments is possible.

1.5. Our services are intended to be used by registered users within Australia only.
2. Our Website Services
2.1. Our services are provided to adults over the age of eighteen (18) years. By proceeding to purchase credits or utilise services through our website, you acknowledge that you are over 18 years of age.

2.2. All prices are in Australian Dollars (AUD) and are inclusive of GST. We reserve the right to amend our prices at any time.

2.3. We act solely as a facilitator between a registered user who wishes to discuss or buy a product or service and a registered user who wishes to sell a product or service (“service provider”) and are not party to any resulting contractual relationships. The settlement of the contractual relationship, including any conflicts regarding, for example, the quality of the service provided by a service provider is not in any way our responsibility and any conflicts arising from a job/bid are to be settled between the service provider and the registered user.

2.4. We make no representations as to the qualifications, quality, safety or legality of any of the service providers. We in no way guarantee that a service provider will perform a service for the amount specified in the service provider’s bid, nor do we guarantee a service provider’s purported identity.

2.5. The registered user should describe the posted job as clearly and precisely as possible to enable the service provider to calculate the cost and post a meaningful bid.

2.6. It is prohibited to appear as a registered user and advertise your own services or the services of a third party through a job post.

2.7. At the end of the bidding period, the registered user can choose who receives the job. She/he is not obliged to take any particular service provider or the lowest bid or any bid at all.

2.8. The content of the post, including all related information, is compiled by the registered user. We do not undertake an editorial role and do not rewrite registered user's posts. The information entered is solely that of the author and we have no knowledge of it and accept no responsibility for it.

2.9. The registered user is solely responsible for the legality of the information posted. It is prohibited to enter content that is in any way insulting, threatening, violent, racist, sexually offensive or that requests the use of dangerous or illegal substances or services as defined by Australian law. It is also prohibited to post religious and political information that could hurt the feelings of those of other religious beliefs and political standing.

2.10. We reserve the right to delete any posts that are in breach of these terms and conditions.

2.11. Registered users can rate suppliers with whom they have worked. When rating, please note that ratings should be composed according to the principles of equality and should not include any illegal, insulting, abusive or criminally punishable content. Ratings which violate these rules will not be published and may be deleted. We reserve the right to take any legal steps necessary against the participant if these rules are violated. Ratings are always the views and statements of the author and are not connected with us.

2.12. Improper assessments, self-assessments or any other form of attempting to adversely or inappropriately influence the rating system is prohibited.

2.13. By allowing us to use the ratings, the user also allows us the indefinite spatiotemporal rights on all existing rights to his ratings text (author's rights, usage rights and other industrial property rights). We have the right to allow the ratings to be freely available, to edit them, to use them for further ratings services and to publish them in any form. The user should declare owners or persons responsible for all brand names used as well as other industrial property rights as long as he has the right to use them.

2.14. We are not responsible for the ratings or other feedback a registered user may provide in relation to a supplier and accept no liability in this regard.
3. Site Access
3.1. When you visit our website, we give you a limited licence to access and use our information for personal use.

3.2. You are permitted to download a copy of the information on this website to your computer for your personal use only provided that you do not delete or change any copyright symbol, trade mark or other proprietary notice. Your use of our content in any other way infringes our intellectual property rights.

3.3. Except as permitted under the Copyright Act 1968 (Cth), you are not permitted to copy, reproduce, republish, distribute or display any of the information on this website without our prior written permission.

3.4. The licence to access and use the information on our website does not include the right to use any data mining robots or other extraction tools. The licence also does not permit you to metatag or mirror our website without our prior written permission. We reserve the right to serve you with notice if we become aware of your metatag or mirroring of our website.

4.1. This website may from time to time contain hyperlinks to other websites. Such links are provided for convenience only and we take no responsibility for the content and maintenance of or privacy compliance by any linked website. Any hyperlink on our website to another website does not imply our endorsement, support, or sponsorship of the operator of that website nor of the information and/or products which they provide.

4.2. You may link our website without our consent. Any such linking will be entirely your responsibility and at your expense. 5.3. Any comment, feedback, idea, rating or suggestion (called “Comments”) which you provide to us through this website becomes our property. If in future we use your Comments in promoting our website or in any other way, we will not be liable for any similarities which may appear from such use. 6. Disclaimers
6.1. To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the services again or payment of the costs of having those services supplied again, whichever we choose.

6.3. We provide the platform for use in its current form and function. No guarantee is made regarding the availability of the system and no minimal availability is certain. The availability of the system may at any time be limited entirely or partly. We accept no liability regarding the limited availability of the system.

6.4. The registered user and/or the author is solely responsible for the content of the information and ratings she/he posts (text, graphics, audio, video, tone, design etc.) as well as for the legal consequences that the content of all these contain. The registered user is solely responsible to check and declare all commercial, brand and copyrights. In the case of third-party claims, the registered user is solely responsible and releases us from any requirements, cost and compensation claims of the third party including legal costs.

6.5. We take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

6.6. From time to time, we may host third party content on our website such as advertisements and endorsements belonging to other traders. Responsibility for the content of such material rests with the owners of that material and we are not responsible for any errors or omissions in such material.
7. Refund Policy
7.1. Where a service provider purchases credits on our website, the service provider agrees that such purchases are non-refundable once the payment has been processed.

7.2. We retain the discretion to provide a service provider with a refund where requested.
8. Indemnity
8.1. By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website, including claims by third parties.
9. Jurisdiction
9.1. These terms and conditions are to be governed by and construed in accordance with the laws of Victoria, Australia and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Victoria and you agree to submit to the jurisdiction of those Courts.

9.2. If any provision in these terms and conditions is invalid under any law, the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
10. Privacy
10.1. We undertake to take all due care with any information which you may provide to us when accessing our website. However, we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
